To expedite resolution and control the cost of any dispute, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any legal proceedings. Such informal negotiations commence upon written notice from one party to the other.
Any dispute that cannot be resolved through informal negotiations shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The number of arbitrators shall be one. The seat of arbitration shall be Ghaziabad, Uttar Pradesh, India. The language of the proceedings shall be English. The governing law shall be the substantive law of India.
The parties agree that any arbitration shall be limited to the dispute between the parties individually. No arbitration shall be joined with any other proceeding, and there is no right for any dispute to be arbitrated on a class-action basis.
